This program will cover the major new developments in all areas of personal injury law over the past year, including:

  • The newly-enacted "SMART Act" and its dramatic changes to the Medicare liens recovery process;
  • the Restatement (Second) vs. Restatement (Third) of Torts controversy in products liability cases and the impact of Reott on the issue of causation;
  • the validity of certain exclusions in UIM and UM policies and setoffs of UIM settlements against liability verdicts after Smith;
  • the current status of the "statutory employer" defense;
  • the applicability of corporate negligence theory to nursing home liability cases after Toney;
  • self-funded ERISA Plan liens after US Airways v McCutchen.
